Terms of Service

This is a general template covering the essentials for a small subscription product and is provided for informational purposes. It is not formal legal advice. If your business grows or handles sensitive data at scale, consider having these terms reviewed by a lawyer licensed in your jurisdiction.

These Terms of Service ("Terms") govern your access to and use of Kaptions (the "Service"), operated by Bhailog Digital ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Kaptions lets you upload videos, generate automatic captions using third-party AI transcription (OpenAI's Whisper), and style and export captioned videos. Some features are available on a Free plan with usage limits; additional features and higher usage limits are available on the paid "Kaptions Plus" plan.

2. Accounts

You must provide accurate information when creating an account and are responsible for maintaining the security of your login credentials. You're responsible for all activity that occurs under your account. Let us know immediately at support@getkaptions.com if you suspect unauthorized access.

3. Subscriptions & Billing

Kaptions Plus is billed monthly in advance via our payment processor, Stripe. By subscribing, you authorize recurring charges until you cancel.
You can cancel anytime through the billing portal accessible from within the app. Cancellation takes effect at the end of your current billing period — you keep access until then, and we do not provide partial-month refunds except where required by law.
We may change pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new pricing.

4. Usage Limits

The Free plan is limited to a set number of videos per month with a maximum video length. Kaptions Plus is limited to a set number of captioning minutes per month. These limits are described on our pricing page and may be updated from time to time; we'll make reasonable efforts to communicate material changes.

5. Your Content

You retain all ownership rights to the videos and content you upload ("Your Content"). By uploading Your Content, you grant us a limited license to store, process, and transmit it solely as necessary to provide the Service to you (for example, sending audio to OpenAI's Whisper API for transcription, and storing your video so you can access it later).

You're responsible for ensuring you have the necessary rights to any content you upload, and that it doesn't violate any law or infringe anyone else's rights. We reserve the right to remove content or suspend accounts that violate this section.

6. Acceptable Use

You agree not to use the Service to upload or generate content that is illegal, infringing, defamatory, or that violates the rights of others; to attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service; or to use the Service in a way that could damage, disable, or impair it.

7. Third-Party Services

The Service relies on third-party providers, including OpenAI (for transcription), Supabase (for authentication, database, and storage), and Stripe (for payments). Your use of the Service is also subject to those providers' applicable terms, to the extent they apply to how your data is processed.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or where required by law. Upon termination, your right to use the Service ends, though certain provisions of these Terms (such as ownership, disclaimers, and limitation of liability) survive.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that transcription output will be error-free, that the Service will be uninterrupted, or that it will meet your specific requirements.

10. Limitation of Liability

To the maximum extent permitted by law, Bhailog Digital and Kaptions will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll make reasonable efforts to notify you (for example, via email or an in-app notice). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law provisions, unless otherwise required by applicable local law.
